1. About these Terms

These Terms form a binding agreement between QuantumAxis ("we", "us", "our") and you ("you", "your") for your access to and use of RatesAppeal (the "Service"). By using the Service, you agree to these Terms and to any policies referenced here (Privacy Policy, Cookie Notice, Acceptable Use Policy, and Data & Content Licensing Policy).

Nothing in these Terms limits any non-excludable rights you have under the Australian Consumer Law (ACL).

2. What we do (and don't do)

2.1 Information only. The Service provides access to Australian property sales data and general metrics (e.g., adjusted land values, comparable sales, component codes) to help you research evidence for potential land value objections. Currently serving NSW with Australia-wide expansion planned.

2.2 Not a valuation. Outputs are not a property valuation, appraisal, market opinion, or professional advice under the Valuers Registration Act or equivalent state legislation. We are not licensed valuers.

2.3 Not legal advice. The Service provides research assistance only. We do not practice law, provide legal advice, or act as your lawyer, advocate, or representative in any objection proceedings under the Legal Profession Act or equivalent state legislation.

2.4 No government endorsement. We are not affiliated with any State Valuer General, local council, or government agency. Use of government data does not imply endorsement.

2.5 AI-generated content limitations. Any AI-generated suggestions, templates, or content are for research assistance only and may contain errors, inaccuracies, or inappropriate advice. Users must review, verify, and take full responsibility for any content they use or submit.

3. Eligibility & accounts

3.1 You must be 18+ and have capacity to contract under Australian law.

3.2 You are responsible for your account, credentials, and all activity under it. Notify us promptly of any unauthorised use.

3.3 One account per person. Business or commercial use requires prior written agreement.

4. Your responsibilities

4.1 Your decisions. You are solely responsible for:

  • How you use the information provided
  • Whether to lodge a valuation objection
  • What evidence to submit to relevant authorities
  • Seeking professional advice where appropriate
  • Compliance with state-specific objection procedures and deadlines

4.2 Data you provide. You warrant that any content you upload (property addresses, valuation notices, documents, notes) is accurate, lawful, and you have rights to provide it.

4.3 Acceptable use. You must comply with our Acceptable Use Policy and must not misuse the Service (e.g., bulk scraping, redistributing data, reselling access, or security testing without permission).

4.4 Professional advice acknowledgment. You acknowledge that property valuation and objection matters may require professional expertise and that you will seek qualified advice where appropriate.

5. Subscriptions, trials, and fees

5.1 Some features require a paid subscription. All prices are shown inclusive of GST as stated at checkout.

5.2 Billing is in AUD per the cycle shown at purchase (monthly/annual). You authorise recurring charges until you cancel.

5.3 Free trials. If offered, trials convert to paid subscriptions unless cancelled before the trial ends.

5.4 Changes. We may change fees with 30 days' notice, effective from your next billing cycle.

5.5 Refunds. Except as required by ACL consumer guarantees, fees are non-refundable once a billing period starts. Your consumer guarantee rights remain unaffected.

5.6 Taxes. You are responsible for any applicable taxes not collected by us.

6. Intellectual property & licence

6.1 We (and our licensors) own the Service, including software, user interface, trademarks, compiled datasets, algorithms, and research tools.

6.2 Your licence. We grant you a personal, revocable, non-transferable licence to use the Service for your own property research purposes in Australia.

6.3 Restrictions. You must not copy, reverse engineer, decompile, create derivative works, or redistribute the Service or any content except as permitted by law or our Data & Content Licensing Policy.

7. Third-party content & data sources

7.1 The Service displays government open data, licensed datasets, third-party links, and uses analytics services including PostHog. We do not control third-party materials and are not responsible for their accuracy, licensing terms, or continued availability.

7.2 Some data is subject to attribution requirements, usage limits, or specific licence terms—see our Data & Content Licensing Policy and Data Sources & Attribution page.

7.3 Government data limitations. Government datasets may contain errors, delays, or omissions. We are not liable for government data quality or changes to data licensing terms.

8. Service availability & changes

8.1 We aim for high availability but do not guarantee uninterrupted access. Outages may occur due to maintenance, provider failures, or events beyond our control.

8.2 We may modify or discontinue features with reasonable notice, ensuring that material changes are communicated in advance.

9. Security

We implement security measures to protect your data. You must keep your credentials secure and notify us immediately of any suspected breach.

10. Privacy

We handle personal information according to our Privacy Policy.

11. Liability

To the maximum extent permitted by law, we exclude liability for indirect or consequential loss. Our total liability for any claim is limited to fees paid by you in the 12 months prior to the claim.

12. Prohibited uses & professional licensing

12.1 You must not use the Service in a way that requires a professional licence or authorisation that you do not hold, including but not limited to:

  • Valuers Registration Acts (any state)
  • Legal Profession Acts (any state)
  • Real Estate Acts (any state)
  • Australian Financial Services Licence regime

13.2 Users requiring professional services in these areas must engage appropriately licensed practitioners.

14. State-specific variations

14.1 Different Australian states have varying:

  • Valuation objection procedures and deadlines
  • Professional licensing requirements
  • Consumer protection laws
  • Government data licensing terms

14.2 Users must comply with requirements in their relevant state/territory. We are not responsible for state-specific compliance failures.

15. Data protection and AI systems

15.1 AI limitations. Our AI systems may:

  • Generate inaccurate or inappropriate suggestions
  • Reflect biases in training data
  • Fail to account for unique property circumstances
  • Provide outdated or incorrect information

15.2 You must verify all AI-generated content before use and take full responsibility for any reliance on AI outputs.

15.3 Data processing. We process your data in accordance with our Privacy Policy and Australian Privacy Principles.

16. Disputes & complaints

16.1 Contact us first at https://www.quantumaxis.com.au/contact. We will attempt to resolve complaints within 30 days.

16.2 If unresolved, disputes may be referred to relevant consumer protection authorities or courts in Australia.

16.3 These Terms are governed by Australian law, with jurisdiction in the courts of the state/territory where you reside.

17. Force majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including government actions, natural disasters, internet outages, or third-party service failures.

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.

19. Changes to these Terms

We may update these Terms by posting a new version with an updated "Last updated" date. Material changes will be notified within the Service or by email. Continued use constitutes acceptance of changes.

20. Definitions

  • "Service": the RatesAppeal website, app, and related services
  • "Content": data, text, graphics, and outputs displayed by the Service
  • "Open data": datasets published by government agencies under permissive licences
  • "Professional advice": advice from licensed valuers, lawyers, or other regulated professionals
  • "AI-generated content": any text, suggestions, or outputs produced by artificial intelligence systems
